Labour Ministry asks EPFO to provide permanent Provident Fund account number soon PTI New Delhi, February 9, 2014 | UPDATED 22:15 IST

The Labour Ministry has asked EPFO to provide permanent PF account numbers to its 5 crore members in a time-bound manner so that they don't need to transfer provident fund accounts after changing jobs.

According to sources, the direction in this regard was given to the Employees' Provident Fund Organisation (EPFO) by Labour Secretary Gauri Kumar at the February 5 meeting of the Central Board of Trustees (CBT), the apex decision making body of the organisation.

"Kumar asked EPFO's Central Provident Fund Commissioner K K Jalan to apprise the board in its next meeting about the progress over the project and to provide a timeline for completing the task," the source further said.

The next meeting, however, has not been scheduled so far.

The permanent PF account number would also help provide social security benefits to workers in sectors like construction where they change contractors and place of work frequently.

According to the 'Action Plan' handed over by the Labour Ministry, the EPFO has to put in place a system for unique employee number which would eventually make its facilities on thee lines of core banking service.

An official associated with the project said it is not difficult to provide this facility in 2014-15 as almost all 123 field offices of the EPFO are digitised and can be connected to a central server.

To provide permanent PF account numbers to subscribers, EPFO will have to set up a central server which would be connected to all of its 123 field offices.

At present, the EPFO subscribers have to apply for transfer of PF accounts on changing jobs. They are provided a new PF account number every time they change jobs.

The EPFO in October last year started the facility of online transfer of PF account on changing jobs.

The facility of online transfer of PF accounts has reduced the work load of the EPFO substantially as over 13 lakh applications are filed for such claims every year.

The EPFO expects 1.2 crore claims in 2013-14, including around 13 lakh PF transfer claims. During 2012-13, it settled 107.62 lakh claims. Eighty eight per cent of these were processed within 30 days, as prescribed by the body's citizen charter.

Labour Ministry asks EPFO to hold clubbing of allowances for provident fund deductions

NEW DELHI: The Labour Ministry has asked retirement fund body EPFO not to go ahead with a proposal to club allowances with basic pay for provident fund deductions, a step that will deprive 5 crore subscribers of higher savings.

"EPFO has got a letter from the Labour Ministry asking it not to go ahead with clubbing of allowances with basic pay. The EPFO will soon issue a notification," a source said.

According to experts, the move would have increased the savings of organise . sector workers under schemes run by the EPFO. It would also have reduced the take-home pay of the subscribers and increased the financial burden on employers. (EPFO) had issued a circular on November 30, 2012, redefining the meaning of "basic wages" for the purpose of PF deductions and said, "All such allowances which are ordinarily, necessarily and uniformly paid to the employees are to be treated as the basic wages."

The EPFO also proposed to limit enquiries into PF deposits made by companies to a period of seven years.

However, the notification was put in abeyance and the EPFO set up a committee to look into the matter and recomme .. further action to the Labour Ministry. The committee had supported the idea of enhancing social security benefits under the EPF scheme run by the EPFO.

Putting the 2012 circular in cold storage would also mean that the EPFO can seek information from employers about PF deposits made on behalf of workers without a time limit. The circular had said, "No inquiry or investigation shall ordinarily go beyond seven years, i.e., it shall cover the period of default not exceeding preceding seven years."

The open assessment, inquiries and investigations serve no real purpose, the circular said, adding, "Such inquiries often don't result in identification of beneficiaries and only tend to harass the employers and establishments."

Minimum Wages in Punjab enhanced

In continuation to earlier circulars, intimating the rise in minimum rates of wages, it is hereby brought to your kind notice that the Punjab Government has further enhanced the minimum rates of wages w.e.f. 01.09.2013 in respect of 71 Scheduled Employments. The increase in wages for monthly rated employee is Rs. 552.75 and for daily rated is Rs. 21.44 & for hourly worker is Rs. 2.68.

The above increase is to neutralize the cost of living. The minimum rates of wages are linked with Consumer price index Numbers (State Series 1987 -100). The adjustment of wages are made after an interval of six months taking the average of CPI numbers compiled by the Punjab Government. The detail of enhanced/adjusted minimum rates of wages for monthly rated and daily rated and hourly rated employees under different categories are given in the attachment. It is pertinent to mention here that vide two separate writ petitions some clauses attached to the parent notification dt. 15.11.2012 issued under the Minimum WagesAct, 1948 are under challenge and the next date for final arguments is fixed for 26.09.2013.

SALARY CAP TO BE RAISED FOR ESI CONTRIBUTIONS

The government is likely to increase the salary cap of beneficiaries to Rs.25,000 from Rs.15,000, w.e.f. 1-10-2013. The decision has been taken despite objections from employers' representatives at a closed-door meeting in Delhi on 19.9.2013. The last increase in the salary ceiling for ESI was made in May 2010, when it was raised to Rs.15,000 from Rs.10,000

Saradha boss gets 3-yr jail for not paying PF

Sudipta Sen, accused in a multi-crore Saradha Ponzi scam that ruined nearly 1.7 million Bengal homes, was on Friday sentenced to three years in prison for not paying Rs 3.68 lakh in employee's provident fund.

This was one of the more recent cases and Sen had pleaded guilty before Bidhannagar sub-divisional magistrate Swati Mukhopadhyay in the pre-trial stage. This is Sen's first conviction in a plethora of cases.

Enforcement Branch inspector Khokan De had lodged a complaint on December 18, 2013, that Sen has defalcated Rs 3.68-lakh in EPF. Three days ago, when the court tried to frame charges, it asked Sen whether he would plead guilty. If Sen refused, it would have led to a trial. But Sen admitted to the charges. The court then ordered a three-day breather in which he was kept in segregation.

Produced before the magistrate on Friday, Sen said: "I was the company managing director. I agree that I have not submitted the PF money entitled to the employees of the Saradha group." The magistrate then ordered three year rigorous imprisonment for criminal breach of trust and criminal conspiracy and a fine of Rs 10,000 for common intent. If he doesn't pay the fine, he has to spend six more months in jail.

Trinamool MP Kunal Ghosh, Sen's close aide Debjani Mukherjee and Saradha media group vice-president Somnath Dutta are also accused in the case. Sen's lawyer Samir Das said: "The prison terms will run concurrently. His date of imprisonment will be calculated from the day of arrest (April 23, 2013) although the case for which he has been convicted was lodged eight months later." This means Sen has already served more than a third of the jail term. Till November 30, 2013, 381 cases and 246 chargesheets related to the Saradha group and implicating Sen had been registered across Bengal. Pending formation of a special court, three cases are already on trial in Bidhannagar courts.

The highest number of Saradha cases is lodged in South Dinajpur. Of the 220 cases filed, the district police have filed chargesheets in 211. On February 2, Calcutta high court had directed the Mamata Banerjee government to set up a special court, preferably in Salt Lake, to hear all Saradha-related cases which are being heard by trial courts statewide. A division bench of Justice Asim Kumar Banerjee and Justice Arijit Banerjee stressed this was imperative for speedy trial
